Treeify Terms of Service

Welcome to Treeify (“Treeify”, “we”, “our”, or “us”).
These Terms of Service (“Terms”) govern your access to and use of the Treeify website, platform, APIs, and related services (“Services”).

By using Treeify, you agree to be bound by these Terms.
If you do not agree, you must not use our Services.

1. Acceptance of Terms

By registering for, accessing, or using Treeify, you represent that:

You are at least 18 years old (or of legal age in your jurisdiction).
You have the authority to enter into these Terms on behalf of yourself or your organization.
You agree to comply with all applicable laws and these Terms.

If you are using Treeify on behalf of an organization, “you” refers to that organization, and you agree that you have the authority to bind it to these Terms.

Treeify provides an AI-powered test case design and generation platform that enables users to analyze requirements, design test objects, generate test scenarios, and export test cases through automated AI systems.

Treeify may include integrations with third-party platforms (such as TestCaseLab, Jira, Notion, GitHub, and CI/CD systems).
Use of those third-party integrations may be subject to their own terms of service.

3. Account Registration and Security

You must create an account to access most features.
You agree to:

Provide accurate, current, and complete information during registration.
Keep your login credentials secure and confidential.
Notify us immediately of any unauthorized access or suspected breach.

You are responsible for all activities that occur under your account.

Treeify reserves the right to suspend or terminate accounts involved in abuse, unauthorized access, or violation of these Terms.

4. Use of Services

You agree to use Treeify only for lawful purposes and in compliance with these Terms.
You must not:

Upload, share, or process content that infringes any third-party intellectual property or privacy rights.
Attempt to disrupt, damage, or gain unauthorized access to our systems or networks.
Reverse engineer, decompile, or copy any part of Treeify.
Use Treeify to develop, train, or fine-tune AI systems that compete with Treeify.
Resell, sublicense, or share Treeify accounts without written permission.

We reserve the right to investigate any violations and take appropriate legal or technical actions.

5. User Content and Data Rights

5.1. Ownership

You retain full ownership of the content you upload or input into Treeify (“User Content”).
Treeify does not claim ownership of your input data, test cases, or generated outputs.

5.2. License to Operate

By submitting content to Treeify, you grant us a limited, non-exclusive, and revocable license to:

Process, store, and analyze your content for the purpose of providing the Services.
Maintain operational backups and improve AI generation quality (in aggregated and anonymized form only).

We will not use your proprietary data to train public or external models without your explicit consent.

5.3. Confidentiality

All User Content is handled in accordance with our Privacy Policy.
We do not access your projects except for system maintenance, debugging, or if required by law.

6. AI-Generated Content and Accuracy Disclaimer

Treeify uses AI models to generate test cases and related materials.
While we strive for accuracy and completeness, AI-generated results may contain:

Inaccuracies, omissions, or ambiguities.
Outputs that require professional review or validation.

Treeify provides all AI outputs “as-is” without warranties of correctness or fitness for a particular purpose.
You are solely responsible for reviewing, validating, and applying generated results.

Treeify shall not be liable for any loss, damage, or cost arising from reliance on AI-generated content.

7. Credits, Billing, and Payment

7.1. Credit System

Treeify uses a credits-based billing model.
Credits correspond to the computational cost of AI processing (e.g., token usage).
Each plan includes a set number of credits; exceeding that limit may require additional purchases.

7.2. Subscription Terms

Paid plans renew automatically unless canceled before the renewal date.
Unused monthly credits do not roll over unless explicitly stated.
Refunds are not issued for partial billing periods or unused credits.
Treeify may adjust pricing or credit rates with reasonable prior notice.

7.3. Taxes

All prices exclude applicable taxes.
You are responsible for any sales, use, or value-added taxes arising from your purchase.

8. Intellectual Property

All Treeify software, algorithms, documentation, and designs remain the exclusive property of Treeify Technologies Pte. Ltd. and its licensors.

You may not:

Copy, modify, or create derivative works of Treeify.
Use Treeify’s trademarks, branding, or materials without written consent.
Remove or obscure any proprietary notices.

These Terms do not grant any ownership rights beyond the limited usage license described herein.

9. Third-Party Integrations

Treeify may allow you to connect with third-party services such as TestCaseLab, Jira, Notion, or GitHub.

Use of such integrations is at your own risk.
Treeify is not responsible for any data loss, disclosure, or functionality caused by third-party platforms.
You agree to comply with the respective third-party terms of service.

10. Service Availability and Updates

Treeify strives for continuous availability but does not guarantee uninterrupted or error-free operation.
We may modify, update, or discontinue features at any time, with or without notice.

We are not liable for any loss or damage arising from maintenance, downtime, or modifications to the Service.

11. Termination

You may cancel your account at any time via your account dashboard or by contacting support.
Treeify may suspend or terminate your account if:

You violate these Terms or any applicable law.
Your activity causes harm to Treeify or its users.
Non-payment or misuse of Services occurs.

Upon termination:

Access to your account will be revoked.
Your stored data may be deleted after a grace period (typically 30–90 days).
Outstanding balances remain payable.

Certain provisions (including sections on liability, indemnity, and IP rights) will survive termination.

12. Disclaimer of Warranties

To the maximum extent permitted by law:

Treeify is provided “as is” and “as available.”
We disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.
We do not guarantee that Treeify will meet your specific requirements or be free from interruption or error.

You assume all risk for using Treeify and any outputs generated.

13. Limitation of Liability

To the fullest extent permitted by law, Treeify and its affiliates shall not be liable for:

Indirect, incidental, consequential, or punitive damages.
Data loss, service interruption, or loss of profits.
Any damages exceeding the amount you paid to Treeify in the preceding three (3) months.

These limitations apply even if we have been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless Treeify, its affiliates, officers, employees, and agents from any claim, loss, liability, or expense (including reasonable legal fees) arising out of:

Your use or misuse of the Services.
Your violation of these Terms or applicable laws.
Your infringement of any third-party rights.

15. Privacy

Your use of Treeify is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

By using Treeify, you agree to our Privacy Policy.

16. Compliance with Laws

You agree to comply with all applicable local, national, and international laws regarding:

Data protection and privacy.
Export control and trade sanctions.
Intellectual property and ethical AI use.

Treeify reserves the right to suspend or restrict use in jurisdictions where compliance cannot be maintained.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles.

Any dispute, claim, or controversy arising from these Terms or your use of Treeify shall be resolved through:

Good-faith negotiation between the parties; and
If unresolved within 30 days, binding arbitration under the Singapore International Arbitration Centre (SIAC) Rules.

The arbitration shall be conducted in English in Singapore.

Each shall supplement (not replace) these Terms.
